Oihan Ataun case in Europe

Different young persecuted by their political activity
According to Ateak Ireki, the behatokia (an institution that protects human rights in basque country) have denounced spanish state in the European Court of Human Rights for the "no investigation of the tortures suffered" by Oihan Ataun. Oihan Ataun was arrested on 10 of November 2008 by spanish police in Nafarroa (south basque country). He was accused of being member of Segi (outlawed in spain and legal in france).

According to Behatokia, Ohian Ataun was tortured during four days by members of spanish police. The defence of the young tried to investigate that denounces of torture but "spanish judicial organs have ignored it".

For Behatokia, it is not the first time that is necessary to use international institutions in that cases. According to them, the fundamental rights are violated during the arrest protected by counter-terrorist law. In the last three years, there have been 4 sentences against spanish state for that kind of cases: 3 of the European Court and 1 of the UN committe against torture.

In spanish state, during the counter-terrorist arrest, people are by police isolated for 5 days. A lot of times, people denounce torture after that isolation: Knockings, asphyxiate with bags and water, psychological pressure, sexual harassment etc.
